1. About us
Thomas Synergy is operated by Martin Thomas, trading as Thomas Synergy ("we", "us", "our"), providing live entertainment for weddings, corporate events, festivals, private parties and community celebrations, through our acts Soul Destination, Kloane and Martin Thomas (solo).
2. Scope of these terms
These Terms and Conditions apply to your use of the Thomas Synergy website and set out the general basis on which we take enquiries and bookings. The specific terms of an individual booking, including the deposit and payment schedule, are set out at the booking enquiry stage and finalised alongside our Terms of Engagement, issued with your booking confirmation. The Terms of Engagement forms a separate, binding contract between us for that booking.
3. Enquiries and bookings

Submitting an enquiry through our website, by email or by phone does not guarantee availability and does not constitute a booking.

A booking is only confirmed once we have issued a Terms of Engagement document setting out the agreed date, fee, deposit and payment terms, and this has been accepted and any required deposit received.

Until a booking is confirmed in this way, we reserve the right to accept other enquiries or bookings for the same date.
4. Payment and cancellation
Deposit amounts, payment schedules, and our cancellation and refund policy are set out in the Terms of Engagement issued for your specific booking. Please read this document carefully before confirming your booking, and get in touch if anything is unclear.
5. Performance requirements
To deliver the best performance, clients are asked to provide suitable space, a safe and adequate power supply, and reasonable access for load-in and load-out at the venue. Specific technical and space requirements for your event will be confirmed ahead of time.
6. Insurance and equipment safety
Thomas Synergy holds Public Liability Insurance, and our equipment is PAT tested. Certificates are available on request, for example if your venue requires proof of these before your event.
7. Photography, video and media use

Public events (such as festivals, corporate events open to the public, or venue performances): we may use photographs or video footage from these events for promotional purposes, including on our website and social media, without needing separate permission.

Private events (such as weddings and private parties): we will only use photographs or video footage from your event for promotional purposes with your permission as the event organiser. Please let us know if you're happy for us to do this, or if you'd rather we didn't.

Guests at any event are welcome to take photos or videos for their own personal use, subject to any rules set by the venue.
8. Liability
While we take all reasonable care in delivering our performances, we cannot guarantee against circumstances beyond our control (see Force Majeure below). Our liability for any claim arising from a booking is limited to the fee paid for that booking, except where liability cannot be excluded or limited by law, for example for death or personal injury caused by our negligence.
9. Force majeure
We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to illness, injury, extreme weather, transport disruption, venue closure, or other events outside our control. Where possible, we will try to arrange a suitable replacement performer or reschedule your event.
10. Website content and intellectual property
All content on this website, including text, images, logos and audio/video clips, belongs to Thomas Synergy or is used with permission, and may not be copied or reproduced without our consent.
11. Changes to these terms
We may update these Terms and Conditions from time to time. Any changes will be posted on this page with an updated "last updated" date. Changes will not affect the terms of a booking already confirmed through a signed Terms of Engagement.
12. Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
